Client Rights, Policies & Procedures

Purpose and Scope

This policy establishes the standards and procedures governing the delivery of psychological and vocational evaluation services at Brighter Day Psychological Services (BDPS). It addresses clients' rights, informed consent, confidentiality, HIPAA compliance, electronic communications, use of websites and mobile applications, billing practices, and professional boundaries.

These policies apply to all clients, parents/guardians, contractors, and staff of BDPS.

Licensure, Qualifications, and Ethical Standards

Brighter Day Psychological Services is operated by licensed psychologists and school psychologists in the State of Florida. Licensure is regulated by the Florida Department of Health, which is responsible for ensuring that licensed psychologists meet minimum standards for safe and competent practice.

All services are provided in accordance with:

  • Florida Statutes and Administrative Codes

  • The American Psychological Association (APA) Ethical Principles and Code of Conduct

  • Applicable federal and state laws governing health information, including HIPAA

Scope of Services

Psychological testing and evaluation services are provided for purposes including, but not limited to:

  • Diagnostic clarification

  • Treatment planning

  • Measuring response to treatment

  • Educational and vocational planning

  • Functional and employability assessments

 

​​Assessment instruments are selected based on the referral question and administered, scored, and interpreted in accordance with standardized procedures. Comprehensive written reports are typically completed within 3–4 weeks following receipt of all test data.

 

No diagnosis or outcome is guaranteed, and reports cannot be altered to accommodate client, family, legal, or third-party preferences.

Mental Health Bill of Rights

Clients are entitled to all rights afforded under the Florida Mental Health Bill of Rights. A copy is:

  • Provided to clients

  • Available on the BDPS website

  • Posted in the office

    Clients are encouraged to review these rights and discuss any questions with their provider.

HIPAA Compliance and Confidentiality

BDPS complies with the Health Insurance Portability and Accountability Act (HIPAA) and all applicable Florida confidentiality laws.

 

Confidentiality Protections

  • Client records are confidential and privileged

  • Information is released only with written authorization, except as permitted or required

    by law

 

Permitted Disclosures Without Authorization

  • Court orders or subpoenas

  • Health oversight and audits

  • Reporting of abuse, neglect, or exploitation

  • Serious threats of harm to self or others

  • Legal defense in the event of a complaint or lawsuit

    Disclosures are limited to the minimum necessary information.

Professional Records

BDPS maintains secure electronic and/or physical records including:

• Intake documentation
• Consents and authorizations • Assessment data and reports • Treatment notes
• Billing records

 

Clients (or parents/guardians) may request copies of records in writing. Fees may apply to cover administrative costs.

Electronic Communications, Website, and Mobile Applications

Email, Text, and Electronic Messaging

  • Electronic communications are not guaranteed to be confidential

  • Clients are advised to limit electronic communication to scheduling or administrative matters

  • Treatment-related issues should be addressed during scheduled sessions

 

Client Portals and Website Use

  • BDPS uses HIPAA-compliant platforms for scheduling, billing, and document exchange

  • Use of the website or portal constitutes acknowledgment of electronic communication

    risks

 

Mobile Applications

  • If mobile applications or portals are used, they are secured through HIPAA-compliant vendors

  • Clients are responsible for safeguarding their login credentials

 

Clients may opt out of electronic communications by notifying BDPS in writing prior to beginning services.

Appointments, Fees, and Payment Policies

  • Appointment reminders are sent electronically (48–72 hours in advance)

  • Payment is due at the time of service unless otherwise arranged

  • Credit card information may be stored securely for billing purposes

     

Fees

Psychological Testing: $250/hour

Therapy (45–50 minutes): $250
Legal-related services: $400/hour
Report Writing: $250/hour
Missed Appointments: $50/hour
(Additional fees outlined in the fee schedule)

 

Reports are not generated until accounts are paid in full.

Minors and Parental Rights

  • Services for minors require parental or legal guardian consent

  • Both parents’ consent is required when both retain decision-making authority

  • Disputes regarding access to records must be resolved by the court

  • Upon turning 18, the client assumes full control of records and treatment decisions

Mandatory Reporting Requirements

  • Licensed psychologists are required by Florida law to report:

  • Suspected child abuse, neglect, or exploitation

  • Abuse of vulnerable adults

  • Serious threats of violence

Conflicts of Interest and Professional Boundaries

​BDPS maintains strict professional boundaries. Dual relationships, social relationships, or inappropriate contact with clients are prohibited. If a conflict of interest arises, referral to another provider may be required.

Court-Ordered and Legal Services

Treatment or evaluation pursuant to a court order will not begin until the order is reviewed. Court-ordered services involve additional limits to confidentiality, and reports may be provided to the referring authority.

Clients may raise concerns directly with BDPS. Complaints may also be directed to:

Emergency and Crisis Coverage

BDPS does not provide 24-hour crisis services. In emergencies, clients should call 911, go to the nearest emergency room, or contact the 988 Suicide & Crisis Lifeline.

Policy Review and Updates

These policies are reviewed periodically and may be updated to reflect changes in law, technology, or professional standards. Updated policies will be made available via the BDPS website or upon request.
